1. Acceptance of Terms
By accessing or using goaep.com and any related tools, guides, assessments, downloads, generators, or content (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services. The Services are operated by Lync, LLC ("Lync," "we," "our"), 400 Travis St. Ste. 309, Shreveport, LA 71101.
2. Who May Use the Services
The Services are intended for licensed insurance professionals, agencies, FMOs/IMOs, and adult business users in the United States. You represent that you are 18+ and, if marketing Medicare products, that you maintain all required state and federal licenses, appointments, and certifications (including AHIP and carrier-specific certifications where applicable).
3. Educational Purpose — Not Legal, Compliance, or Financial Advice
All content, lessons, strategy guides, checklists, scoring, PDFs, and AI-generated outputs are educational and informational only. They are not legal advice, compliance advice, tax advice, financial advice, or a substitute for the CMS Medicare Communications & Marketing Guidelines (MCMG), TCPA, HIPAA, state insurance laws, or your upline/carrier rules. You are solely responsible for your own compliance.
4. AI-Generated Content
Portions of the Services use third-party artificial intelligence models (including but not limited to large language models and image generators) to draft text, create images, score assessments, and produce personalized reports. AI outputs may contain errors, omissions, hallucinations, or biased content. You must independently verify any AI-generated output before relying on it, publishing it, or sharing it with consumers. We make no warranty as to the accuracy, currency, or fitness of AI-generated material.
5. License to Use
Subject to these Terms, Lync grants you a limited, revocable, non-exclusive, non-transferable license to access the Services for your internal business education. The 15-page guide and any downloaded PDFs are licensed to you for personal/agency study only — you may not resell, white-label, sublicense, or redistribute them.
6. Account & Data You Submit
When you submit your name, email, agency, NPN, phone, or assessment answers, you warrant that the information is accurate and that you have the right to provide it. You consent to our processing of that data as described in our Privacy Policy. By submitting an email or phone number, you consent to receive related communications about GoAEP, Lync products, and AEP/industry updates. You may opt out at any time.
7. Prohibited Conduct
- Reverse engineering, scraping, or harvesting the Services or AI outputs at scale.
- Uploading false NPNs, fake leads, or impersonating another agent/agency.
- Using the Services to violate MCMG, TCPA, state DNC rules, or carrier guidelines.
- Sending unsolicited marketing to consumers using content generated here.
- Interfering with the Services, our infrastructure, or other users.
8. Third-Party Tools & Links
The Services reference and link to third-party platforms (e.g., NIPR, CMS, Google, Resend, Supabase, AI model providers, and Lync product surfaces such as Lync CRM, Lync Greetings, and LyncCIS). We are not responsible for third-party content, availability, or practices. Your use of those services is governed by their own terms.
9. Intellectual Property
GoAEP is a brand of Lync, LLC. All Services, branding, layouts, copy, graphics, lessons, and the underlying software are owned by Lync or its licensors and are protected by U.S. and international IP laws.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. See also our Disclaimers page.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNC, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, COMMISSIONS, OVERRIDES, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
12. Indemnification
You agree to indemnify and hold harmless Lync, LLC and its affiliates from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right — including any CMS/MCMG/TCPA enforcement action tied to how you used material from the Services.
13. Termination
We may suspend or terminate your access at any time, with or without notice, for any reason, including suspected misuse. Sections 3–12, 14, and 15 survive termination.
14. Governing Law & Venue
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts located in Caddo Parish, Louisiana, and you consent to that venue.
15. Changes
We may update these Terms from time to time. Material changes will be reflected by a new Effective date. Continued use after changes constitutes acceptance.
16. Class Action Waiver & Jury Trial Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND LYNC EACH AGREE THAT ANY DISPUTE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, COLLECTIVE, MASS, OR REPRESENTATIVE ACTION. YOU AND LYNC EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY SUCH DISPUTE. If a court determines that this waiver is unenforceable as to a specific claim, that claim (and only that claim) will be severed and proceed in court, while the remaining claims continue to be governed by this section.
17. Educational Understanding & Assumption of Risk
You acknowledge that the Services are educational, that Medicare rules change, that AI outputs can be wrong, and that your own compliance with CMS, MCMG, TCPA, HIPAA, state licensing, and carrier rules is your responsibility. You assume the risk of relying on any content, script, drill, scenario, or AI-generated output without independent verification.
18. Consent to Electronic Communications & Records
You consent to receive notices, agreements, disclosures, and other communications from Lync electronically — by email, in-product notification, or posting on the Services. Electronic records satisfy any legal requirement that such communications be in writing.
19. Severability & Entire Agreement
If any provision of these Terms is held to be unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full effect. These Terms, together with the Privacy Policy, Cookies Policy, and Disclaimers, constitute the entire agreement between you and Lync regarding the Services, and supersede any prior understandings on the same subject.
20. No Waiver & Assignment
Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
